2012 - opportunities, risks and issues in the trust, fiduciary and wealth planning industries

Wednesday 18 April

2012 has started with many important developments of interest to Jersey trust companies. How might they affect you and your business? And what impact will they have on Jersey as a jurisdiction?

Tax, trust and the UK government - we will look at the UK's increasing focus on anti-avoidance and offshore trusts, including whether new HMRC investigation powers can be used to get information from offshore trustees.

Jersey foundations - as well as considering the Jersey market in 2012, this session will take a closer look at how foundations have fared since their introduction, considering their popularity, uses and and some of the practical issues that have arisen.

Family governance - what are the latest trends and how are fiduciary structures being used to support family wealth preservation?

Challenging times on the high street - Channel Islands commercial property in 2012

Queen of Shops Mary Portas says Britain's high streets have reached a crisis point.

After her independent review at the request of the Prime Minister, she said: "Unless urgent action is taken much of Britain will lose, irretrievably, something that is fundamental to our society, and which has real social and economic worth to our communities."

The reasons for the decline are numerous, but the economic downturn has no doubt exacerbated issues and Jersey's high streets are not immune.

In this seminar we will review and discuss the state of commercial property in the Channel Islands, focusing on the current market for both office and retail sectors, suggesting ways to rejuvenate our high streets and options for landlords and tenants.

Are you being served? Freezing injunctions, search orders and fraud investigation notices

In these financially straitened times, creditors are becoming more inventive and aggressive in the protection, recovery or replacement of their assets. 

As the financial crisis leads to the uncovering of fraudulent activity, the use of investigatory and pre-judgment measures, such as search, freezing and fraud investigation orders, is increasingly prevalent. 

The effect on financial services businesses can be significant as they are forced to walk a tightrope between the order's often draconian requirements and their own obligations to their client.

This seminar will look at the investigatory and pre-judgment toolkit and consider from a financial services perspective what steps a business should take when they are the subject of, or affected by, an order.
