Dispute Resolution
Dispute Resolution is a core strength of Collas Crill. Our
approach to contentious matters is hands-on, cost-effective and
commercial. Our expertise and reputation means we're first choice
for a range of clients, including banks, trust companies, high net
worth private individuals and top law firms.
Whether our client is based locally or internationally, they
want to know they're in expert hands, that we will take a practical
approach and our approach will be tailored to the client's
interests. Client and industry feedback shows that we meet these
needs, being considered 'a safe pair of hands all round' in Legal
500 and a 'highly skilled and cost-effective team' by Chambers and
Partners 2011.
We specialise in top-flight commercial dispute resolution and
litigation matters, including:
- Financial and banking litigation
- Tracing actions, asset freezing, disclosure orders and other
pre-trial remedies
- International debt recovery, reciprocal enforcement of
judgments and obtaining evidence for the purpose of foreign
proceedings
- Fraud and anti-money laundering
- Trust and estate disputes, and contentious probate
- Professional negligence
- Insurance and reinsurance
- Contractual disputes
- Company law including disputes between shareholders and
directors
- Telecommunications, e-commerce, intellectual property
disputes
- Insolvency and restructuring
- ADR including mediation, arbitration and expert
determination
Our core activity is complemented by some niche specialisms
including family law, personal injury and clinical negligence, and
employment.
Our priority is always to resolve disputes in the most effective
way for clients, whether by way of litigation or by arbitration,
mediation or another form of alternative dispute resolution.
Where litigation is unavoidable, we focus on working towards our
client's commercial objectives while assessing the inherent legal,
commercial and reputational risks.
We are actively involved in many of the headline cases in the
Channel Islands, notably advising the first defendant in the
complex Alhamrani trust case - the largest piece of litigation ever
seen in Jersey - and acting for Deloitte as the joint
administrators of Landsbanki Guernsey on the first administration
order since the new Companies Law 2008, a major cross-border
case.
To us, teamwork is key and our Dispute Resolution specialists
work closely with our Corporate and Banking and Finance practices
to advise on restructuring, recovery and insolvency matters.
